Deleting an AI chat should not be treated as proof that every related copy has been removed. Map the prompt, uploaded files, provider records, application logs and exported outputs separately, then establish the retention and deletion treatment for each. Check the actual service terms and configuration rather than assuming all workplace AI products behave alike.
Ireland's Data Protection Commission published an AI Insights Report announcement on 25 September 2026. This is a recent regulator development, not a new blanket retention deadline. Its earlier guidance on AI, large language models and data protection remains a useful starting point for evaluating personal-data use and provider arrangements. The operational register below is an original method that needs appropriate privacy and legal review in context. Key takeaways
Inventory copies by location and purpose. Separate training settings from retention settings. Assign an owner for the organisation's records and verify the provider's stated treatment. Do not claim anonymisation or complete deletion without supporting evidence and an understood scope.
Trace one real workflow
Choose a specific use case, such as preparing a draft supplier response from an approved internal document. Map where the source is copied, uploaded, processed, logged and exported. Include integrations and browser extensions where they are actually used; do not assume the chat interface is the only system involved.
Identify personal data and confidential business information at each step. Record the business purpose and responsible owner. Where the workflow processes personal data, the appropriate privacy team must assess the applicable lawful basis, transparency, contractual and rights-related requirements. A convenient AI feature does not resolve those questions.
Separate four different decisions
Determine what input is permitted, whether the provider may use it for model improvement, how long each copy is retained and who can access it. These decisions are related but not interchangeable. A setting that excludes training may still leave a record retained for another stated purpose.
Read the current terms for the exact service and account type, including relevant processor arrangements and subprocessors where applicable. Record the version or retrieval date and any unresolved question. Product settings and contracts can change; avoid applying consumer-service assumptions to an enterprise account or the reverse.
Build a copy-level register
For each location, record the data category, purpose, owner, access group, proposed retention treatment and deletion mechanism. Include whether deletion is immediate, queued, subject to a backup cycle or limited by a justified retention obligation. Mark unknown provider behaviour as unresolved rather than filling the gap with a guess.
Keep a reference to the evidence supporting the treatment, such as a contract provision, documented configuration or authorised test result. This article does not establish a universal number of retention days. Appropriate periods depend on purpose, necessity, applicable requirements and the particular processing arrangement.
A hypothetical Irish drafting workflow
Assume a fictional business uploads an approved supplier letter, generates a draft response and exports the result to its document system. An application integration also records an operational log. These are invented circumstances, not a description of a particular AI vendor.
Deleting the chat affects one location according to that service's documented behaviour. The original letter and exported draft remain in the document system unless its own retention process acts on them. The integration log has a separate owner and may contain either minimal event metadata or more content than intended.
The team therefore checks each copy, reduces unnecessary logging and records the supported deletion outcome. It does not report all data deleted merely because the chat disappears from the screen. Where a legal hold or justified retention obligation applies, the privacy and records owners resolve it through the appropriate process.
A copy register that prevents an unsupported deletion claim
Complete the fictional supplier-letter example at the point when a user has deleted the visible chat. Assume the team has inspected its own document store but has not obtained provider-side deletion evidence. These are teaching assumptions, not observations about a real service.
| Copy | Fictional evidence state | Accurate register entry |
|---|---|---|
| Original letter | Still in the controlled supplier folder | Retained under its business-record schedule |
| Visible chat | No longer shown in the interface | Interface removal observed; scope of underlying deletion not established |
| Exported draft | Still in the document store | Separate retained copy; not removed by the chat action |
| Integration log | Content fields have not been inspected | Unresolved; integration owner must check what was recorded |
| Provider backups | No relevant evidence supplied | Unresolved; seek the applicable terms and deletion explanation |
The overall outcome is deletion not substantiated across the workflow. It is not “all copies deleted” and it is not a claim that deletion is impossible. The records owner can describe known retained copies, while the service and integration owners resolve the remaining locations.
Keep deletion requests and legal-hold decisions distinct. A justified retention exception should identify its actual scope and responsible decision, rather than becoming a blanket reason to keep every copy. Use invented test content for technical inspection and retain the evidence of the inspection without unnecessarily recreating the deleted material.
Verify without exposing more data
Use invented test records where possible to inspect the workflow and confirm which systems receive information. Do not upload sensitive material simply to test whether a provider deletes it. Agree any production verification with the security and privacy owners.
Check whether users can export, share or reconnect records after the expected deletion point, within authorised access. Document the scope and limitations of the check. A local test cannot prove the state of every provider backup; claims about those copies need appropriate provider evidence.
Use AI workflows with meaningful human checks to connect the retention map to input controls, human checks and output responsibility. Revisit the map when the provider, integration, account type or business purpose changes.
Questions teams ask
Does disabling model training mean no data is stored
Not necessarily. Verify training use and retention separately for the exact service and agreement.
Can one retention period cover every copy
It may be inappropriate because purposes and obligations differ. Set and justify the treatment at each relevant location.
Is a deleted chat automatically anonymised
No. Deletion and anonymisation are different concepts. Neither should be claimed without understanding the actual processing and evidence.
